I would like to tell you what just happened to me today. My store manager called me to say I am no longer employed. I had a conversation a week and a half ago with my supervisor and relayed to him how the hours cut was a hardship for me, and told him if I had to borrow gas money to get to work, I might as well quit. He went back to the office and put down that I had given him a verbal notice to quit. They gave me the runaround for a week as I was trying to get back on the schedule, and I get the call today that I no longer am employed. Since I gave no such thing as a notice, was I fired? If I try for unemployment, they are going to say that I quit. Advice, please

It is a shame that the legal profession monopolizes our court system so that you have to pay one of them (legel mercenaries) to do anything in court. What they do is not that difficult, I know, I have done it. It doesn’t take a law school degree to learn how to do it but the courts won’t allow me to do it unless I jump through the hoops that they have set up to prevent people from doing what lawyers do. They get paid millions for doing something that any reasonably intelligent person can do. The founders of this once greatest nation that ever existed are probably rollong in their graves at the distortion that the legal profession has made of the Sixth Amendment “right to have the assistance of counsel.” They added that right to allow people who had little education to use the assistance of an educated friend or associate but nowhere, except what the legal profession has institutionalized, is there a requirement on who can act as counsel.

We have come a long way in the last couple years but maybe it’s time to turn up the heat a little. It’s time we empower our fellow associates in the everyday struggle to get Wal Mart to see let alone acknowledge the issues. What we associates need to do is form an association for Wal Mart associates. It would be more effective than even Corporates fear of a union presence. 100,000 members that paid $ 5.00 a month dues would generate $500,000 a month that 95% could be banked and used to hire the same caliber Lawyers and Law firms they like to flaunt. The fact that they could litterly is in court in every state and county in the United States, and that when big issues come up then they represent 100,000 members brings the proceedings to the public eye in every case! Any bank in the country would jump at the chance to have 475,000 deposited every month into their bank. Since the funds are ear marked to legal services the account would be open to public scrutiny and denies Wal Mart from claiming that it is all a Union plot! As the association grows so would the funding for legal issues that are bound to come up with Wal Marts business model. 200,000 members would buy the associate $950,000 a month in top notch legal representation.

I had supported OurWalmart in the past. I launched successful page against: walmart winona Minnesota store #5397 that gathered 84,000 page views on Facebook. Ourwalmart after promising local support failed the support and I could not continue the Facebook page. I believe in the Movement. i have No faith in current leadership of Ourwalmart.com and UFCW. So long as current leadership wants stupid 15 second sound bites on cable channels, you will fail in this movement. You Need to support grassroots like I attempted before being slapped down by both Ourwalmart and UFCW. My own EEOC lawsuit against Walmart Winona Minnesota store #5397 continues on its own. Your organization failed. I proceed on my own. You need new leadership to make change.

Mr, Snodgrass – I call it a bug, but in my belief it was put there on purpose. The Bible calls it “the Sin of Pride” better known today as “Arrogance.” In a nutshell what I said in my previous post is that arrogant people who believe they know better how everybody, including you and me, should conduct our lives. They believe that they should be leaders because of their arrigant belief that they have knowledge that other people don’t have and should become leaders no matter how much disonesty and deceit it takes to get positions of leadership. Just because I know how I should conduct my life doesn’t make me able to determine how the rest of the people, including you, should conduct your lives as long as you and they are NOT harming anybody. You have the right to conduct your life any way you please.The Ten Commandments are a good guidline but the first one requires that I bow before God. If you are an atheist you have the right to believe whatever you want including that there is no God or purpose to life, but if you try to force your religion on me you are in violation of the First Amendment to the law that supercedes even the Bible here, the Constitution of the United States!

I don’t know if you saw this response that I replied to your comment by email initially, so I will paste it here: I have not finished reading your email I am busy now. But from the first couple sentences I can tell you are terribly wrong about one thing. There are no bugs in God’s design. We all have our free will. Without free will ‘faith’ would be impossible and faith is the key to knowing God. Probably not much need to read any further. Man has the free will to do anything we want with this earth and this world. It is utterly childish to blame what we do with it on God. Now after reading the rest of your email I do agree with the rest of it. Except for this first important point.

Mr. Snodgrass – what can you expect from the bug in God’s design of humans. That bug is that those who most seek leadership positions are exactly the people who should not lead? When you look at people who start successful endeavors, involving many people, that live long after their deathes, they are the kind of people who should lead. Take the for instance of Sam Walton. He was a good leader who just wanted to see retail stores that would operate efficiently and make the price of goods cheaper. (Bill Gates is not dead yet but I can already see his endeavor, Microsoft, turning into an evil empire,) As is the result in Sam Walton’s, and most cases, after their deathes, in a very few short generations, those who most want to but are the worst qualified to lead, take over and the endeavor turns into a tyrannical empire. This is obviously the case with Sam Walton’s endeavor. I think he was a good leader and great entrepreneur who created an empire with a purpose and the purpose (cheaper products) has turned it into an empire where the leaders are so enterested in pursueing it’s purpose that they care nothing about those who are working under their leadership. Sam’s dead but it hasn’t taken long after his death to turn his idea into an empire run by tyrants.

This is probably the most important lessons that I wasn’t taught by those whose purpose is to prepare us for life’s trials when I was young but learned from many years of experience. Too bad I’m not young enough to start over and try to oust the tyrants from positions of leadership. The reason that this lesson is not generally accepted is because those in positions of leadership, both in government and private enterprise, don’t want the masses to know the truth about them. They are stupid tyrants. Take the greatest endeavor ever started by a few courageous and brilliant men, The United States of America. Those people now in Washington DC are nearly all tyrants who will use any form of deceit to convince, We the People, that they are trying to make the nation better when they are nearly all stupid seekers of power who haven’t a clue why the plan of the founders is no longer working!

No American Citizen Should Have to Live and Work With a fear in Their Heart of Reporting Abuse of Another Human Being in the Workplace. ( D.C. UFCW told me that OW leaders determine where the money given to fundraisers by good-hearted people intending to help people like me who have suffered and sacraficed so much for this cause goes) My story and all the persecution and hell I have been put through in retaliation for reporting the managers abuse of a handicapped female employee when everyone else, although they could all see and hear the abuse and hysterical crying, were all afraid to report it, is very difficult to summarize briefly here, but it has caused me massive finanacial and other damages, destroying everything I had achieved with the last and final 10 best prime working years of my life which I had invested in the company since coming through very tough struggles in my own life that nearly killed me, and although I have already lost everything, I have since been working diligently to do everything I can to stand-up for change and try to prevent this from happening to anyone else. I saw that alot of money was raised through contributions of good-hearted people intending to help people who have sacrificed and suffered so much for this cause such as me, but I have not recieved any help asistance or support of any kind at all. I am in desperate and dire financial need from massive financial damages suffered from walmarts retaliation against me for my efforts to stand up for change at walmart. My case is one of the worst I’ve heard of. Even despite multiple NLRB charges for illegal termination for engaging in protected activity, and illegal retaliation, and absolute documented proof of numerous civil and labor violations, and even a police statement proving serious federal crimes comitted against me and the courts in walmarts telling defamatory lies and falsifying documents to federal investigators, they completely skated. And here is your response: Then this movement lacks Vision of the overall goals it claims to promote. I met with representatives in person in Winona, Minnesota, September 2013. All three of us were in agreement that starting a movement in the smaller markets like Winona, Minnesota; and, indeed Rochester, Minnesota; can Only help to further the March towards Civil Rights of All Walmart Associates. Your opinion indicates that a massive infection like Walmart can only be taken down from the top. Like pruning branches of a tree. I disagree. Logic clearly points to a better result of promoting change. A movement against an organization like Walmart Can Only be achieved from the Bottom, UP! There is No other way this Movement can achieve its Goal of fair representation for its associates. You know this. The issue that concerns me the most is that There Was support in organizing and linking this local movement against area Walmarts with the National efforts: and that this local involvement; Once endorsed; is left lacking in support in our Local efforts to join this cause. And, Yes, Facebook is free and I could well sense your sarcasm. Facebook also offers the Option to Promote Civic causes to expand better coverage through Facebook’s’ marketing. I used this marketing option to greatly increase the promotion of OurWalmart.org in forming an Alliance with the National Movement. In this endeavor I appear to have failed as there is No support from the National level. So present to me a better way of Organizing Change from multiple directions for an Effective instrument of Change for Equality. This is Not an attack against your observations just a request for a better way.

I wasn’t aware that it cost money to maintain a Facebook page. I thought they were free.
That aside, organizations like OurWalmart aren’t going to put a lot into organizing boycotts against Walmarts in rural areas because there’s no place else for people to shop. Boycotts are more likely to work in places where people have alternatives and they do get attention because there are news organizations close by and they get on TV and generate a lot of publicity.
Right now the pressure is on to raise the minimum wage and Walmart is being used as the horrible example of a multi-billion dollar business underpaying its employees and sending them to the local welfare office for food stamps.
No matter how much you may want to, you’re not going to put your local Walmart out of business.

Who else can I reach? The representatives I met in September, in Winona, Minnesota; one rep. each from Ourwalmart.org and UFCW; have pledged support but have done nothing to help me send our press releases indicating a need to organize against this Winona, Minnesota Walmart, just in time for Black Friday. I have spent a lot of money maintaining the Facebook page I set up: Facebook (search): Walmart Winona Minnesota 101 1500 hundred hits and counting yet no Real support from either Walmart.org or UFCW. I respect the goals of both organizations but I am hugely disappointed in no support from either in boycotting this Walmart in a non major market. I feel the lack of support from both organizations will in time erode the efforts against Walmart worldwide. So long as organizers ignore the smaller markets that Walmart infests and go for splashy headlines and 30 seconds of fame on major cable outlets when they move against Walmarts’ in major cities, the effort will fade away. You NEED to attack the roots to take down the Tree. Common sense to me. Don’t understand this impass I am facing. I will continue this fight on my own and one day perhaps the major unions against Walmarts will take notice of my continued efforts.

I need to answer these posts. The EEOC has filed charges. I await the response from the EEOC and Walmart Winona, Minnesota store 5397 to decide what actions are next in line. The NLRB is next when Walmart will deny all charges. Walmart always denies all charges. My concerns which are major, is that I met with reps of Ourwalmart and UFCW in September 2013 here in Winona Minnesota. An alliance I had assumed had been formed between my Individual efforts and both respective organizations. To date I have had No support from either organization in my attempts to bring fairness in: wages, open door policy and a strike this coming Thanksgiving extending through the Christmas season. And this lack of support is totally wrong. I realize that boycotting larger Walmarts in Major cities draws good publicity but minor markets such as Winona Minnesota can only boost the great goals of both organizations. You Need to attack the roots of any infection to promote growth. What I proposed should have been integrated into the over all far reaching goal against Walmart. It was Not. I take actions entirely on my own. I will continue to do so, alone if necessary. This Walmart has illegally terminated: Native Americans; I am Native; people with physical disabilities; people with terminal illness and those who simply stand for their rights. I simply turned to this site since those reps I met this past September 2013 lack insight in coordinating an inclusive front against Walmart. All markets need to be focused on, not just those markets that gain a minute or two on national media.

what i am trying to say is that OUR Walmart has lawyers to help you file your claims with NLRB, EEOC. They are connected with the UFCW and that’s all they do…Labor Law. Why would anyone, especially one that has been terminated without income, want to pay for a lawyer when they can get the advice and help they need for free?

Karin, You may feel comfortable handling this situation if it was you without a lawyer, But many would not. We have top rated attorneys all over the country and believe me they are highly paid! Legalshield is similar to an HMO so before you tell Nicholas what he needs, do some homework like over 1.2 million have done that are members of this company.

Really Daniel? What Nicholas needs to do is contact the NRLB where they will take his complaint and investigate what happened WITHOUT a lawyer. OUR Walmart and the NLRB has helped many people get the their terminations and discipline marks reversed. Nicholas needs to connect with one of the leader members of OUR Walmart. Getting a volunteer lawyer thru your spammy post here is not gonna cut it

I have started my own petition against Walmart Store 5397 located in Winona, Minnesota. I was illegally terminated for being part Native American, fighting for my rights under A.D.A. and involving the State of Minnesota Dept. of Human Rights and the City of Winona Human Rights commission to enforce my rights under A.D.A.. Winona Walmart eventually allowed me to park in handicapped parking stalls and City of Winona forced Winona Walmart to provide handicapped parking area behind the T.L.E. where I was employed as a service writer. Three weeks later I was illegally terminated for ‘providing customer service.’ Really! I set up a Facebook page: Go to Facebook and search for: Walmart Winona Minnesota 101. There you will find the EEOC charges that were filed against Walmart Winona. Charges: Illegal Termination based on race-part Native American, Illegal Termination based on my rights under A.D.A. being continually denied and retaliation-illegal Termination. I also started several days ago a petition on Change.org I have tried hard to get the local news media involved in reporting these actions but both have refused, I assume out of fear of loosing advertising revenue from the local Walmart. I tried to get a local investigative news reporter involved but she has been muzzled by her editor. I met with reps. of Ourwalmart.org and UFCW this past September at Perkins in Winona Minnesota. Although I have their backing neither group will take any supportive actions on my behalf until I can assemble at least a dozen supporters willing to take action with me. Meaning I am currently stalled on all fronts and fighting this Walmart entirely on my own. I had asked support of Ourwalmart.org to consider issuing a press release covering my attempts to organize in Winona, Minnesota but have had no success. So I continue to fight on my own. I am one of three Native Americans fired from this Walmart store and I have tried to engage the local Native Community to help me form this proposed boycott. Reminding the elders that Walmart presently has cases going through Federal Courts of Walmarts intentionally building on Native Burial grounds. Without visible public backing Natives will not engage. Sue could use some help here in Winona Minnesota. Thanksgiving and Christmas holidays are rapidly approaching.

Jamie, i believe you were terminated illegally. The CSM’s are not authorized to give anyone else’s numbers out for use on anything. Not even their own if they are not the person that is using them. I don’t understand how this even happened. The CSM gave you the numbers or did they log in to the register with those numbers and then turn the regisiter over to you? how did they do this?

I worked for Walmart one summer. Lasted less than four months. I will never set foot in another Walmart ever again.
I was always getting yelled at, reprimanded, scolded, coached for doing what I was told. So if you got fired for doing what you were told to do, I’m not surprised

I was terminated September 5, 2013 because we CSM’s were told to use the numbers of a couple Assistant Managers. The AM that fired me was one of them. Now I know of 2 more associates that have been let go since me. We all were coached out the door. The point and coaching system bites.

there is a policy in the Hartford,ct store that the 3rd shift employees have to ask for permission to go to the bathroom. If they do not have a doctors note stating a health issue, they are only allowed to use the bathroom at break times .

First let me say that I am a past Walmart worker and a current union member. I remember the horrible things and the way we were treated/ threatened. I remember the anti union meetings etc. I and many of my union brothers are with you and will help if we know how. Also, someone made a great point. Fastest way to get fair labor practices is hit them in the wallet. How about planning a “solidarity day” in which union members and supporters do not shop at Walmart? The Walmart rhetoric is from the top down. Sam Walton must have spun in his grave 100000 times over. In solidarity

I’m not quite following you here. I don’t understand how surveillance cameras would help if you would have to install them at the job site. It’s not your building so how do you do that?
As far as recording goes, if you have the equipment you can do what you want. People are recording and taking pictures of each other without asking permission all the time. Whether it can be used as evidence in a court of law is another issue.

I’m thinking of Spy cameras. When I was being bullied I did some research into Spy recorders After seeing the Karen Klein video, I did some research into spy cameras. Below is a list of links that are examples of Audio & Video surveillance, and 2 web pages I found about the laws of surveillance. It is unclear about employee taping employer laws. Please do more research and consult with a lawyer.
